Guide to Signing a Will

Wills and Codicils

A beneficiary mentioned in a Will or their spouse CANNOT sign the document as a witness. This also applies to any Codicil requiring witnesses signatures.

IF THE DOCUMENT BEING SIGNED IS A WILL OR CODICIL, IT MUST NOT BE PINNED OR STAPLED TO ANY OTHER DOCUMENT.

Signing a will or Codicil

1. The enclosed Will requires your signature at the side of the end clause (the Attestation Clause). You must not merely print your name, (e.g.; using capitals) but put your usual signature as if you were signing a cheque.

2. Your signature MUST be witnessed by two adults. The witnesses must sign their usual signature, then print their name, putting their address and occupation, where appropriate. THEY SHOULD NOT BE RELATED TO YOU. Note that a beneficiary of his/her spouse must not witness the will. An executor is not a beneficiary if they are unpaid.

3. All three of you should be in sight of each other and the will throughout the signing.

4. A witness MUST know they are signing to witness your signature on a will but need not read the will or know its contents.

5. Please DATE the Will where indicated.
